The Firms Bio

Luxenburg & Levin, LLC was founded in Cleveland, Ohio in 2006. The partners, Mitchel Luxenburg and David Levin, began their consumer litigation/lemon law careers working for one of the largest lemon law firms in the country. While we gained a great deal of experience working for that firm, we also listened to our clients and developed a model of practicing law that we believe best serves our clients. Our principles as lawyers are rooted in taking a personal interest in every one of our lemon law cases. We know that is the approach that will be most effective for you. You should never feel like your important legal matter has been handed off to an inexperienced attorney, or an entry-level associate with no long term vested interest in the firm.

In addition to lemon law and breach of warranty cases, we are proud to represent consumers in a variety of different legal matters. Luxenburg & Levin also represents consumers in claims under the Fair Debt Collection Practices Act, suing unscrupulous debt collectors for violating consumers' rights in the collection of debts. In addition, we handle claims under the Fair Credit Reporting Act, assisting consumers who have been damaged by the reporting of false information on their credit records or by the unauthorized review of their credit reports. Consumer fraud is another area of focus of our firm, including consumer claims for odometer disclosure violations and rollbacks, misrepresentations regarding a vehicle's history, auto dealer financing scams and other unfair and deceptive business practices.

DAVID B. LEVIN

Mr. Levin is one of the founding partners of Luxenburg & Levin, LLC. Mr. Levin began his legal career in 1992, working in private practice and then as in-house counsel for a multi-corporation business, before founding the Law Office of David B. Levin, P.C. which he operated until 1998. It was during this time that Mr. Levin discovered the satisfaction and enjoyment in representing consumers in the fight against big business, representing the rights of tenants in disputes with their landlords.

In 1998, Mr. Levin was pivotal in the formation of the Ohio division of one of the nation's largest lemon law firms, and he managed that firm's Ohio practice until joining with Mitchel Luxenburg to found Luxenburg & Levin, LLC in 2006. During that time period, Mr. Levin managed more than 2,500 cases involving defective vehicles, lemon law, breach of warranty and automobile dealership fraud. Since 1998, Mr. Levin's main concentration in his practice has been in the area of consumer protection litigation. He has been involved, throughout the states of Ohio, Illinois and West Virginia, in all aspects of the litigation of consumer law cases, including pre-suit negotiations through settlement. To date, Mr. Levin has personally handled over 25 trials, including many jury trials involving defective vehicles. He has also participated in the appeal of more than 15 cases involving lemon law and breach of warranty issues. Over 99% of the lemon law cases handled by Mr. Levin have settled without going to trial.

In 2008, Mr. Levin was chosen by Thomson-West, one of the nation's largest legal publishing companies, as the co-author of the Ohio Lemon Law chapter of the Ohio Consumer Law book. This text is intended to be a comprehensive guide for lawyers throughout Ohio on handling lemon law and breach of warranty claims. Mr. Levin has also appeared on the WKYC-TV, channel 3 in Cleveland, Ohio to discuss various lemon law and consumer law issues.

Mr. Levin is licensed to practice law in the states of Ohio, Illinois and West Virginia, as well as in the United States District Courts for the Northern District of Ohio, Southern District of Ohio, Northern District of West Virginia, Southern District of West Virginia, Northern District of Illinois and Northern District of Indiana. Mr. Levin has also appeared as co-counsel in several cases in the Middle District of North Carolina. Mr. Levin graduated from The Ohio State University in 1989 with a Bachelor of Arts in Journalism degree and from the University of Toledo College of Law in 1992.

KYLE R. SALYER

Mr. Salyer works with Luxenburg & Levin, in the State of Kentucky. He was raised in Johnson County, Kentucky. Mr. Salyer graduated from Alice Lloyd College in 2003 with a Bachelor of Arts degree in History and English and from the Valparaiso University School of Law in 2006. Mr. Salyer has been licensed to practice law by the Supreme Court of Kentucky, the United States District Courts for the Eastern and Western Districts of Kentucky, and the United States Sixth Circuit Court of Appeals. In addition to his work with Luxenburg & Levin on consumer protection matters, Mr. Salyer also concentrates his practice in representing plaintiffs in personal injury claims. He is a member of the Kentucky Bar Association, the American Bar Association and the Kentucky Justice Association.

JAMES M. ERVIN

Mr. Ervin works with Luxenburg & Levin, in the State of South Carolina. He grew up in Florence, South Carolina and obtained his bachelor's degree from the College of Charleston. Mr. Ervin graduated from the South Carolina School of Law in 2004 and was admitted to practice law in the State of South Carolina later that year. Mr. Ervin has handled matters in the Circuit Courts of all 46 counties throughout South Carolina and he is also admitted to practice before the United States District Court for the District of South Carolina. Mr. Ervin is a member of the American Bar Association, the Richland County Bar Association and the Lexington County Bar Association. In addition to his work with Luxenburg & Levin on consumer protection cases, Mr. Ervin handles legal matters involving criminal defense, family law, contracts, personal injury, workers compensation, insurance claims and intellectual property.

MITCHEL E. LUXENBURG

Mr. Luxenburg is one of the founding partners of Luxenburg & Levin, LLC. Mr. Luxenburg began his legal career in 1999 with an AV-Rated (best rating) complex civil litigation firm in Summit County, Ohio, representing the interests of both plaintiffs and defendants throughout Northeast Ohio. His responsibilities included all phases of litigation, including researching and drafting causes of action and appellate court briefs.

In 2001, Mr. Luxenburg joined one of the nation's largest lemon law firms, managing their Ohio office until his departure in 2003, at which time he founded the Law Office of Mitchel Luxenburg. Since 2001, Mr. Luxenburg's practice has concentrated primarily in the area of consumer protection litigation. He has been involved, throughout the states of Ohio, Maryland and North Carolina, in all aspects of the litigation of various consumer law cases. To date, Mr. Luxenburg has personally handled 16 jury trials and argued nine cases in Ohio appellate courts, including the Supreme Court of Ohio. Over 99% of the lemon law cases handled by Mr. Luxenburg have settled without going to trial.

In 2008, Mr. Luxenburg argued before the Ohio Supreme Court in the case of David Curl v. Volkswagen of America, Inc. This was only the third case ever accepted for review by the Ohio Supreme Court relating to the Ohio Lemon Law. The Curl decision helped to clarify two important issues involving lemon law and breach of warranty cases in the State of Ohio.

Mr. Luxenburg is licensed to practice law in the states of Ohio and North Carolina, as well as the United States District Courts for the Northern District of Ohio, Southern District of Ohio, Eastern District of North Carolina, Middle District of North Carolina, Western District of North Carolina, and District of Maryland. In 1997, Mr. Luxenburg obtained his master's degree in business administration (MBA) from Kent State University. While at Kent State, Mr. Luxenburg was recognized with several leadership awards and appointed by Governor George Voinovich to serve a two-year term on the Kent State University Board of Trustees, where he worked closely with and advised University administrators on campus issues and policies. In 1999, Mr. Luxenburg graduated from the University of Akron School of Law. In 2009, Mr. Luxenburg was elected to the Beachwood, Ohio City Schools Board of Education. He currently serves as the Board’s Vice President.

JONATHAN E. AGIN

Mr. Agin works with Luxenburg & Levin, in the State of Maryland and the District of Columbia. Mr. Agin is a native of Cleveland, Ohio who graduated from John Carroll University with a Bachelor's Degree in Communications. After spending two years as an account executive and marketing representative for a Fortune 500 company, he attended and graduated from the Case Western Reserve School of Law. While in law school, Mr. Agin served as a Contributing Editor to the Case Western Reserve Law Review.

Since receiving his Juris Doctor degree, Mr. Agin has been a trial attorney in Washington, D.C. Mr. Agin has acted as lead trial counsel in numerous civil matters in Washington, D.C. and Maryland. Additionally, Mr. Agin has successfully mediated and arbitrated several large medical malpractice and general liability cases in both Washington, D.C. and Maryland. Mr. Agin has also argued before the District of Columbia Circuit Court of Appeals.

Mr. Agin is licensed to practice law in the District of Columbia, the State of Maryland, the United States District Court for the District of Columbia, the United States District Court for the District of Maryland and the United States Supreme Court. In addition to his work with Luxenburg & Levin on consumer protection matters, Mr. Agin focuses his practice in the areas of medical malpractice, security cases, premises liability matters, auto torts, construction cases and insurance coverage.

CELIA BANKS WASHINGTON

Ms. Washington works with Luxenburg & Levin in the State of Michigan.  She is a native of the Detroit metropolitan area.  In 1982, Ms. Washington graduated from the Detroit College of Business with a Bachelor of Science degree in Business Administration.  After many years working as a senior paralegal/warranty litigation case manager with a major automobile manufacturer, Ms. Washington attended the Detroit College of Law at Michigan State University, graduating with honors in legal research and writing.  

Since receiving her law degree, Ms. Washington has worked as a judicial law clerk and staff attorney to the judiciary of the Oakland County Circuit Court, Assistant Corporation Counsel for a local municipality and as regional outside counsel for a major automobile manufacturer.  Ms. Washington focuses her practice in the areas of litigation and consumer law. She is licensed to practice law in the State of Michigan, as well as the United States District Courts for the Eastern and Western Districts of Michigan.
